By accessing and using StartupGPT ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

StartupGPT is an AI-powered platform that helps entrepreneurs:

  • Validate and refine startup ideas
  • Generate business plans and market research
  • Create landing pages and full-stack applications
  • Manage advertising campaigns
  • Access startup resources and tools

Analytics and Session Recording

We use analytics tools including PostHog to record and analyze how users interact with the Service. These recordings capture page navigation, clicks, scrolls, and form interactions to help us improve the user experience. We do not capture, store, or have access to any credit card information, payment card data, bank details, or other financial information through these recordings. All payment processing is handled exclusively by Stripe, a PCI-DSS compliant payment processor, and sensitive payment data never touches our servers or analytics tools. Password fields are automatically masked and are not visible in any recording. Session recording is only activated with your analytics consent.

3. User Accounts

To use StartupGPT, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account
  • Accept responsibility for all activities under your account

You may not share your account or allow others to access it.

4. Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to gain unauthorized access
  • Abuse, harass, or harm others
  • Use the Service for illegal or fraudulent purposes
  • Reverse engineer or copy our technology
  • Scrape or harvest data from the Service

5. Intellectual Property

Your Content

You retain ownership of content you create. By using StartupGPT, you grant us a license to:

  • Store and process your content to provide the Service
  • Use anonymized/aggregated data to improve the Service

Our Content

The Service, including all code, designs, and features, is owned by StartupGPT and protected by copyright and other intellectual property laws.

6. Payment Terms

For paid subscriptions:

  • Fees are billed in advance on a recurring basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You authorize us to charge your payment method
  • Failed payments may result in service suspension

Platform Fee: For applications generated through StartupGPT that accept payments via Stripe Connect, we collect a 20% platform fee on all transactions.

7. AI-Generated Content

Important disclaimers about AI-generated content:

  • AI-generated content may contain errors or inaccuracies
  • You are responsible for reviewing and validating all content
  • We do not guarantee the quality or suitability of AI output
  • Business advice should not be solely relied upon without professional consultation

8. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Merchantability and fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless StartupGPT from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another
  • Content you submit or generate

10. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any reason with notice

You may cancel your account at any time through your account settings.

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
